These Terms of Service ("Terms") govern your use of postmortem.so ("Service"), operated by postmortem.so ("we", "us", or "our"). By creating an account or using the Service, you agree to these Terms.
postmortem.so is an API monitoring and incident post-mortem generation service. We monitor your designated endpoints, detect incidents, and use AI to generate post-mortem reports automatically.
Eligibility: You must be at least 18 years old and capable of forming a legally binding contract to use the Service.
Account responsibility: You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
Accurate information: You agree to provide accurate and complete information when creating your account.
Free tier: The Free plan is limited to 200 accounts on a first-come, first-served basis. We reserve the right to adjust this limit.

Free plan: Available at no cost, subject to the limitations described on our pricing page (1 project, 5 endpoints, 5-minute check intervals).
Paid plans: Pro (€39/month) and Team (€99/month) plans are billed monthly in advance via Stripe. Prices are in Euros and exclude any applicable taxes.
Upgrades and downgrades: You may change your plan at any time. Upgrades take effect immediately. Downgrades take effect at the start of the next billing period.
Cancellation: You may cancel your subscription at any time. Your access to paid features continues until the end of the current billing period. We do not provide refunds for partial months.
Failed payments: If a payment fails, we will notify you and may suspend your account after a reasonable grace period.
The Service uses Anthropic's Claude API to generate post-mortem reports based on your incident data. You acknowledge that:
Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of data as described in our Privacy Policy.
Your data: You retain ownership of all data you input into the Service, including endpoint configurations, incident data, and post-mortem content.
Our licence: You grant us a limited licence to process your data solely for the purpose of providing the Service.
We aim to provide a reliable service but do not guarantee uninterrupted availability. The Service is provided "as is" without warranty of any kind.

Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
You agree to indemnify and hold us harmless from any claims, damages, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
Our IP: The Service, including its design, code, and content, is owned by us and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written consent.
Your IP: You retain all intellectual property rights in the content you create using the Service.
By you: You may delete your account at any time through the account settings.
By us: We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any other reason at our sole discretion, with reasonable notice where possible.
Effect of termination: Upon termination, your right to use the Service ceases immediately. We will delete your data in accordance with our Privacy Policy.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice of significant changes where possible.
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms. We will notify you of material changes by email.
These Terms are governed by the laws of the Republic of Croatia, without regard to its conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts of Zagreb, Croatia.
